marcus tullius cicero, born 106 before christ, has as his guiding principle the rhetorical appropriateness of style to subject, audience and situation. the ideal orator unites in him wisdom and eloquence. for quintilian, born around the year 35 and more than a century later, clarity – grounded in a constant tie-back to usefulness and the moral standing of the orator – forms a basic virtue on which everything else builds. cicero relies on rhetorical effect, quintilian focuses more on the danger of abuse. while the romans quarrel over the length of their togas and whether these may extend over the shoes, demagogic rhetoric – with which orators play on the fears of the masses against existing institutions – already poisons the atmosphere in ancient athens of the 5th century before christ, from the mouth of the politician cleon. he attacks the educated elite directly, sees rhetorical deliberation in quintilian’s sense as weakness and uses the common sense of the ordinary population as rhetorical underpinning. in the late roman republic, publius clodius pulcher perfects this pattern as cicero’s direct opponent, as “a politicizing thug and prototype of the unprincipled agitator, a parasite” – so the historian luciano canfora – who uses street violence as a political tool to stoke the crisis of the roman state, which ultimately ends in civil war. as a populist protector of the powerless, he first vilifies the senate as a corrupt cartel, for according to joseph goebbels a lie need only be repeated often enough to become believable. complexity is then broken down into clearly understandable black-and-white patterns, and the true people are pitted against corrupt elites who block their rise.
language here does not serve factual communication in cicero’s sense, but the pure generation of fear, anger and longing for a supposedly long-lost better order. from roland freisler, probably the best-known criminal judge of national socialist germany, to senator joseph mccarthy, no direct connection can be drawn, since mccarthy operates rather out of the specific context of 1950s us anticommunism; both positions, however, use strikingly similar rhetorical structures in the conduct of their defamatory proceedings. the respective tribunal is turned into a stage of humiliation; both freisler at the nazi people’s court and mccarthy in his senate committees use interrogations not to establish truth but as a demonstration of power – defendants are systematically interrupted, shouted down, made ridiculous and condemned in advance. in both cases the burden of proof is reversed, mere accusation takes its place, and even a possible bare acquaintance with other suspects counts as sufficient complicity. denying the accusations is read as proof of deception or concealed hostility. in the use of collective fears of an inner enemy – here traitors to the people, there communists – deviation from the norm is presented as an existential threat. as a consequence, the parallels lie only in the method: freisler is a judge in a totalitarian, forcibly unified system without a free press or independent appeals body, equipped with absolute power, who hands down thousands of death sentences. mccarthy, by contrast, is an elected actor in a constitutional state with separation of powers, with free media that can ultimately strip him of power together with the senate.
mccarthy’s weapons are character assassination, social ostracism and professional bans, so-called blacklisting; an exact number of his victims is not known, but historians estimate that during the early 1950s between 10,000 and 12,000 americans are directly affected through job losses, blacklists or interrogations, and millions more suffer under the climate of fear. simplification of complex social processes, asymmetry of freely invented or distorted claims, and adaptation of rhetoric to the most modern and current medium of the respective era – the cup is now cheerfully passed on. roy cohn, mccarthy’s young chief counsel and adviser, is the driving legal force behind his communist-hunting, perfects the approach of using suspicion without solid evidence as a political weapon, manipulating media and accusations, and aggressively intimidating opponents. richard nixon is already familiar, before cohn’s main period, with the mechanisms of the anticommunist camp, among other things in the house committee on un-american activities, huac. both nixon and fbi chief j. edgar hoover sympathize with mccarthy’s approach and the circles that politically support and legitimize it. cohn remains an influential figure in the background of us politics and serves as an informal adviser and ally to conservative presidents, including nixon and ronald reagan. uncompromising harshness, attacks on institutions and media with the awareness that the end justifies the means, later lead him to also work as legal mentor and lawyer for donald trump. and so the trophy of malicious mechanics wanders on to the austrian jörg haider, the frenchwoman marine le pen also wants a sip of it. he provides the hindutva ideologue narendra modi in india with corresponding motivation and gives the japan-first party, with makoto sakurai’s radical street agitation, the corresponding basis for its aggressive, xenophobic populism …

Geboren 106 vor Christus ist Marcus Tullius Ciceros Leitprinzip die rhetorische Angemessenheit des Stils an Gegenstand, Publikum und Situation, der ideale Redner vereint bei ihm Weisheit und Beredsamkeit. Für Quintilian, um das Jahr 35 und mehr als ein Jahrhundert später geboren, bildet die auf eine ständige Rückbindung an Nutzen und moralische Statur des Redners basierende Klarheit eine Grundtugend, auf der alles andere aufbaut. Cicero setzt auf rhetorische Wirkung, Quintilian fokusiert eher die Gefahr des Missbrauchs. Während sich die Römer über die Länge ihrer Togen balgen und ob diese über die Schuhe ragen dürfen, vergiftet die demagogische Rhetorik, mit der Redner die Ängste der Masse gezielt gegen bestehende Institutionen ausspielen, schon im antiken Athen des 5. Jahrhunderts vor Christus aus dem Munde des Politikers Kleon die Atmosphäre. Dieser greift die gebildete Elite direkt an, sieht rhetorisches Abwägen im Sinne Quintilians als Schwäche und nutzt den gesunden Menschenverstand der einfachen Bevölkerung als rhetorische Untermauerung. In der späten Römischen Republik perfektioniert Publius Clodius Pulcher dieses Muster und direkter Gegner Ciceros als “politisierender Rowdy und Prototyp des prinzipienlosen Agitators, ein Schmarotzer” – so der Historiker Luciano Canfora –, der die Gewalt der Straße als politisches Mittel nutzt, um die Krise des römischen Staates zu schüren, was schlussendlich im Bürgerkrieg endet. Als volksnaher Beschützer der gesellschaftlich Ohnmächtigen verunglimpfe zunächst den Senat als korruptes Kartell, denn nach Joseph Goebbels muss die Lüge nur oft genug wiederholt werden, damit sie glaubhaft wirkt. Komplexität zerlege man sodann in klar verständliche schwarz-weiße Muster und stelle in Folge das wahre Volk gegen dessen Aufstieg verhindernde, korrupte Eliten.
Sprache dient hier nicht sachlicher Kommunikation im Sinne Ciceros, sondern der reinen Erzeugung von Angst, Wut und der Sehnsucht nach einer vermeintlich lange verlorenen besseren Ordnung. Von Roland Freisler, dem wohl bekanntesten Strafrichter des nationalsozialistischen Deutschlands, zu Senator Joseph McCarthy lässt sich keine direkte Verbindung ziehen, da dieser eher aus dem spezifischen Kontext des US-amerikanischen Antikommunismus der 1950er-Jahre heraus agiert; dennoch verwenden beide Positionen auffällig ähnliche rhetorische Strukturen in der Führung ihrer diffamierenden Prozesse. Das jeweilige Tribunal wird zu einer Demütigungsbühne umgestaltet; sowohl Freisler am NS-Volksgerichtshof als auch McCarthy in seinen Senatsausschüssen nutzen Befragungen nicht zur Wahrheitsfindung, sondern als Machtdemonstration – Angeklagte werden systematisch unterbrochen, niedergebrüllt, lächerlich gemacht und vorab verurteilt. In beiden Fällen wird die Beweislast umgekehrt, die reine Anschuldigung tritt an deren Stelle und eine mögliche, bloße Bekanntschaft mit anderen Verdächtigen gilt als ausreichende Mittäterschaft. Das Bestreiten der Vorwürfe wird als Täuschungsbeleg oder verdeckte Feindseligkeit ausgelegt. In der Nutzung kollektiver Ängste vor einem inneren Feind – hier Volksverräter, dort Kommunisten – wird die Abweichung von der Norm als existenzielle Bedrohung dargestellt. In der Konsequenz liegen die Parallelen nur in der Vorgehensweise: Freisler ist Richter in einem totalitären, gleichgeschalteten System ohne freie Presse oder unabhängige Revisionsinstanz, ausgestattet mit absoluter Macht, der Tausende Todesurteile fällt. McCarthy hingegen ist ein gewählter Akteur in einem Verfassungsstaat mit Gewaltenteilung, mit freien Medien, die ihn zusammen mit dem Senat letztendlich entmachten können.
McCarthys Waffen sind Rufmord, soziale Ächtung und Berufsverbot, das sogenannte Blacklisting; eine genaue Zahl seiner Opfer ist nicht bekannt, aber Historiker schätzen, dass während der frühen 1950er-Jahre zwischen 10.000 und 12.000 Amerikaner direkt durch Berufsverluste, Schwarze Listen oder Verhöre betroffen sind und Millionen weitere unter dem Klima der Angst leiden. Vereinfachung komplexer gesellschaftlicher Vorgänge, Asymmetrie der frei erfundenen oder verzerrten Behauptung und Anpassung der Rhetorik an das modernste und gängigste Medium der jeweiligen Epoche – der Kelch wird nun munter weitergereicht. Roy Cohn, junger Chefankläger und Berater McCarthys, ist treibende juristische Kraft hinter dessen Kommunistenhatz, perfektioniert den Ansatz, Verdächtigungen ohne belastbare Beweise als politische Waffe zu nutzen, Medien und Vorwürfe zu manipulieren und Gegner aggressiv einzuschüchtern. Richard Nixon ist bereits vor Cohns Hauptzeit mit den Mechanismen des antikommunistischen Lagers vertraut, unter anderem im Komitee für unamerikanische Umtriebe, HUAC. Sowohl Nixon als auch FBI-Chef J. Edgar Hoover sympathisieren mit McCarthys Vorgehen und den Kreisen, die dieses politisch unterstützen und legitimieren. Cohn bleibt eine einflussreiche Figur im Hintergrund der US-Politik und fungiert als informeller Berater und Verbündeter für konservative Präsidenten, darunter Nixon und Ronald Reagan. Kompromisslose Härte, Angriff auf Institutionen und Medien mit dem Bewusstsein, der Zweck heilige die Mittel, lassen ihn später auch als juristischen Mentor und Anwalt für Donald Trump arbeiten. Und so wandert der vergiftete Pokal boshafter Mechanik hin zum österreichischen Jörg Haider, die Französin Marine Le Pen will auch davon nippen.
